    The 1099-C Tax Trap

    The Mortgage Debt Forgiveness Act has expired.

    If you do a short sale and the bank forgives $100,000 of your loan, they will send you and the IRS a Form 1099-C. The IRS will now treat that $100,000 as if you earned it at a job.

    Unless you qualify for specific exclusions (like insolvency or bankruptcy), a short sale could result in a massive tax bill. In some cases, a foreclosure is actually the safer financial choice.

    Anti-Deficiency Laws

    A deficiency judgment is when the bank sues you for the remaining balance of the loan after a foreclosure or short sale.

    Some states, like California, have strong Anti-Deficiency laws. If your loan is "non-recourse" (typically a purchase money loan), the bank generally cannot sue you for the difference.

    However, second mortgages, HELOCs, and refinances are often "recourse" loans, meaning you are completely exposed without a properly negotiated approval letter.

    Foreclosure Timelines & The 120-Day Rule

    Under federal law, there is a 120-day (4-month) "cooling-off" period after your first missed payment before a servicer can officially initiate foreclosure proceedings. However, once that period expires, time runs out quickly.

    • Non-Judicial States (e.g., CA, AZ, TX): Fast. Once the federal 120-day period ends, the state process begins (e.g., filing a Notice of Default in CA), which can take as little as 110-120 days to reach auction.
    • Judicial States (e.g., FL): Slower. Requires court filings, giving you more time to negotiate a short sale or modification.
